Email: icheltonyhowell@gmail.com (Weekdays 9:00-18:00, excluding statutory holidays)

Applicable Users: This application is intended solely for adult users aged 18 and above. We do not provide services to any minors under the age of 18, nor do we collect any personal data from minors.

Scope of Application: This Privacy Policy applies to all services provided globally by the BalletGrace mobile application (hereinafter referred to as "this App"), including but not limited to all functional modules such as viewing visual logs, creating art cards, publishing content, recording practice duration, in-app purchases, and all data processing activities arising from your use of this App.

This Privacy Policy aims to clearly and comprehensively inform you of all rules regarding our collection, use, storage, protection, sharing, and transfer of your personal data, clarify your various data rights as a data subject under applicable laws, and outline the measures we take to ensure data security. This App does not have a registration/login function. You only need to check the box to agree to this Privacy Policy and the User Terms to use all features of this App. We will strictly process your personal data in accordance with global data protection laws and regulations such as the General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA), the California Privacy Rights Act (CPRA), the Virginia Consumer Data Protection Act (VCDPA), the Brazilian General Data Protection Law (LGPD), the French Data Protection Act (FADP), the Australian Privacy Act 1988, the UK Data Protection Act 2018, as well as the privacy compliance requirements of the Google Play Store, to effectively protect your privacy security and legal rights.

I. Legal Basis for Data Processing

All our processing of your personal data strictly adheres to the principles of legality, fairness, necessity, and good faith, based on the following clear legal grounds, ensuring that each data processing activity complies with the requirements of regional data protection regulations, as detailed below:

1. User Consent: Your action of checking the box "Agree to Privacy Policy and User Terms" when first opening this App, as well as subsequent actions to actively grant permissions such as camera, photo library, and microphone, constitute your explicit, voluntary, and withdrawable consent for us to process the corresponding personal data. This is the core legal basis for our processing of permission-related data (e.g., images captured by the camera, audio recorded by the microphone). You may withdraw this consent at any time through device settings or in-app operations.

2. Performance of a Contract: To provide you with the core services of this App, such as creating ballet art cards, browsing visual logs, publishing content, saving favorites, recording and exporting practice duration, etc., we need to process necessary personal data (e.g., images you create, edited text, practice data). This data processing is a necessary part of performing the service contract between you and us, ensuring you can normally use all features of this App.

3. Legitimate Interests: Without harming your legitimate rights and interests or violating your reasonable expectations, we will conduct necessary data processing to optimize the app experience, ensure operational security, handle user reports and blocking requests, prevent malicious operations, and improve app functionality. For example, collecting app version numbers and device system versions to adapt to different devices and fix operational issues; storing your report/block records to filter inappropriate content and create a safe environment. Such data processing aligns with our legitimate business interests as the data controller and will not have a significant impact on your privacy rights.

4. Legal Obligation: If required by applicable laws and regulations, judicial authorities, or regulatory bodies (e.g., data protection supervisory authorities, courts, public security organs), we will process your personal data in accordance with the law, such as providing relevant data as required by legal documents and cooperating with investigations. We will protect your personal privacy to the greatest extent permitted by law.

II. Scope and Methods of Personal Data Collection

We strictly adhere to the "principle of data minimization" when collecting personal data. We only collect information indispensable for achieving the App's functional purposes and do not collect any personal data unrelated to its functions. This App has no registration/login function and does not collect identity information such as your account, password, email, phone number, or ID number. All personal data is collected directly within the App, with no indirect collection from third parties or any background automatic data collection. All data collection is triggered by your active operations. The specific scope and methods are as follows:

(I) Personal Data Based on Permission Grants

We only collect corresponding data after you actively grant relevant permissions, and the data is used solely for explicit functional purposes. Collection and processing cease immediately upon permission revocation.

1. Camera Permission Data: After granting camera permission, we only collect image data you capture via the camera when you actively click the "Capture" button. This data is used solely for three explicit purposes: 1) creating ballet art cards in the "Studio" tab; 2) publishing new posts via the "Publish" function; 3) setting your profile avatar. We do not collect any additional data during camera operation such as preview frames, capture logs, or location data. Captured images are only stored when you actively save or publish them. Unsaved images are deleted immediately without leaving any trace.

2. Microphone Permission Data: After granting microphone permission, we only collect voice memo audio data you record when you actively click the microphone icon to trigger the recording function. Recording is limited to a maximum of 15 seconds. This audio data is used solely to add voiceovers to the ballet-themed art cards you create, recording your descriptions, thoughts, or related music clips about that ballet moment. We do not perform any form of background recording nor collect any other audio data under the microphone permission. After recording, you choose whether to save it. Unsaved recordings are deleted immediately.

3. Photo Library Permission Data: This permission is divided into read and write permissions, exercised independently.

(1) Read Permission: After granting read permission, we only read image data you actively select from your photo library when you click the "Select Photo" button. This data is used solely for three scenarios: ballet art card creation, new post publishing, and profile avatar setting. We do not proactively scan or read any unselected images in your library, nor collect additional information like folder structure, image capture time, or location data. We only obtain the original content of your selected images for functional implementation.

(2) Write Permission: After granting write permission, we only write image data (e.g., ballet art cards you create, generated art prints, practice data summary posters) to your photo library when you actively click buttons like "Save to Album" or "Export". We do not automatically write any data in the background, nor modify or delete any existing images in your library. All write operations are triggered by you, and the ownership of the written data belongs to you.

4. External Storage Permission Data: We collect local cache data generated during App operation, your created content data (e.g., art cards, art prints, post content), operation record data (e.g., favorites, reports, blocks), coin balance data, practice duration records, etc. This is solely for local storage and reading, ensuring you can view historical creations, operation records, and practice data when reopening the App. We do not access or read any data in external storage unrelated to this App, such as files from other apps, private user photos, or documents. All data stored externally is saved in encrypted form.

5. Application Information Read Permission Data: We collect basic device data such as your device's app installation information (only the installation/uninstallation status of this App), device system version, app version number, device model, and processor information. This is used solely for three purposes: 1) ensuring normal operation across different devices and system versions, fixing compatibility issues; 2) providing app update notifications; 3) analyzing operational faults to optimize stability and improve experience. We do not collect information unrelated to this App, such as lists of other installed apps or their usage duration.

6. Advertising Identifier Data: We collect your device's Advertising ID (ADID) solely to provide you with personalized ads related to ballet and art, reducing irrelevant ads and improving ad experience. You can disable the Advertising ID via device settings (e.g., "Settings - Privacy - Ads" on Android). Upon disabling, we will immediately stop collecting this data. This does not affect core App functionality.

(II) Personal Data Generated by In-App Operations

This data is generated by your active in-app operations. We only store it locally to enable corresponding functions.

1. Creation & Publication Data: Ballet art card data you create in the "Studio" tab (including template selection, images, text editing, color settings, voice memos), art print data generated on "Detail Pages", and post data published via the "Publish" function (including title, description text, images, voice notes) are all edited/generated by you. We store them locally for your subsequent viewing, editing, exporting, or sharing.

2. Operation Record Data: Your favorite content records (favorited feed cards, artworks), report/block operation records (reported/blocked content ID, operation time), coin balance data, coin consumption/recharge records (stored locally only, not shared with third parties), creation/save behavior records (creation time, save count, export records), etc., are generated by your in-app operations to enable functions like favorites, reporting, blocking, in-app purchases, and creation management.

3. Practice-Related Data: When you use the newly added "Practice Timer" function, self-recorded practice duration, countdown settings, weekly practice statistics, etc., are generated by your active use of this function. This data is used solely for visual presentation (e.g., charts) and one-click export, helping you track practice progress. It is stored locally only, with no transmission or sharing.

(III) No Automatically Collected Personal Data

Special Note: This App does NOT collect any of the following personal data, and there is no background automatic data collection. All data collection is triggered by your active operations:

• Location information (including GPS, cell tower, WiFi positioning);

• Contact lists, call logs, SMS data;

• Bank card information, payment passwords, ID information, email addresses, phone numbers, or other identity/financial information;

• Browsing history, search records, app usage duration (except for in-app operation records within this App);

• Device unique identifiers like IMEI, IMSI, MAC address (except for the Advertising ID).

III. Purposes of Personal Data Collection and Use

All personal data we collect is used solely for the following explicit and specific purposes. Without your separate written consent, it will not be used for any purpose beyond this scope, nor for activities unrelated to the App's functions such as data mining, algorithmic analysis, or user profiling. All data processing is completed on your local device, with no meaningless cross-device or cloud data transmission. Specific purposes are as follows:

1. Enabling Core App Functions: This is the primary purpose, including:

(1) Providing ballet visual log browsing services, displaying curated ballet moments, dancer lines, stage performances, etc., immersing you in the aesthetic atmosphere of ballet art.

(2) Providing interactive creation functions in the "Studio" tab, supporting template selection, image upload, text editing, color adjustment, and voice memo recording to create your own ballet-themed art cards.

(3) Providing content publishing functions, supporting image upload, title/description editing to publish your ballet moments, practice records, preserving personal dance-related memories.

(4) Providing favorite functions, allowing you to save preferred ballet visual content and artworks for quick future viewing.

(5) Providing the "Practice Timer" function, supporting practice countdown setting, duration recording, generating practice data charts, and one-click data export to help track progress.

(6) Providing the "Save as Art Print" function, generating high-quality art prints from your favorite ballet content (image + title + decorative border + watermark) and saving them to your photo library.

2. Optimizing App Experience: Based on your in-app behavior (e.g., creation preferences, favorite types, usage frequency), we optimize the App, including:

(1) Optimizing interface layout and interaction logic for more convenient and smooth operation.

(2) Recommending art card templates more aligned with your preferences based on your creation habits.

(3) Analyzing operational fault information (e.g., crashes, lag) combined with your device info to fix issues and improve stability.

(4) Optimizing feature priority based on your usage frequency for easier access to commonly used functions.

3. Ensuring App Content Safety: To create a safe, healthy environment, we use your report/block records to filter inappropriate content (e.g., improper images, illegal text), handle your reports, and block illegal content. We also store operation records to prevent malicious operations (e.g., malicious reporting, frequent saving).

4. Providing In-App Purchase Services: We store your "Grace Coin" balance, consumption records, and recharge records (locally only) to ensure normal virtual currency transactions, enabling you to recharge, spend coins, and use paid features (e.g., save/publish functions after exceeding free limits). We do not collect any payment information. Payment operations are handled via Google Play's official in-app purchase service.

5. Enabling Local Data Storage & Export: Storing your created content (art cards, prints), published posts, practice data, operation records, etc., on your local device ensures you can view historical data upon reopening the App. The one-click export function allows you to export creations and practice data to your photo library.

6. Displaying Personalized Ads: Based on your device's Advertising ID, we provide personalized ads related to ballet, art, and dance. You can disable personalized ads via device settings at any time, after which generic ads will be shown without affecting core functionality.

IV. Data Retention Practices

We strictly comply with the principle of "minimum necessary retention" for personal data retention, and the retention of all personal data collected by the App is based on the explicit functional needs of the App and the requirements of applicable laws and regulations. We will not retain your personal data for a longer period than is necessary to achieve the collection purposes and legal compliance requirements.

1. Retention Basis and Principle: The retention of your personal data is mainly based on the need to provide you with continuous App services (such as viewing historical creations, practice records, and operation logs) and the compliance requirements of relevant global data protection laws and regulations. We adhere to the principle of "retention only for the period required for the purpose", and will automatically or manually delete the relevant data once the retention purpose is achieved and there is no legal obligation to retain it.

2. Specific Retention Periods:

(1) All personal data (including creation data, operation records, practice-related data, etc.) is stored only on your local device, and the retention period is completely determined by your use of the App and active operations: if you continue to use the App, the data will be retained on the device until you actively delete the specific data or uninstall the App; if you actively delete a certain type of data (e.g., a single art card, a published post), the data will be permanently erased immediately; if you uninstall the App, all locally stored personal data will be completely deleted without residual traces.

(2) For the small amount of device basic information (e.g., system version, App version) collected for the purpose of App operation and optimization, we only retain the valid information during your use of the App, and will immediately stop retaining the relevant information if the App is uninstalled or the information is no longer needed for functional optimization.

(3) In case of legal obligations (e.g., judicial investigation, regulatory requirements), we will retain the relevant personal data for the period required by the legal document, and will delete the relevant data in a timely manner after the legal obligation is completed.

3. Reasons for Retention:

(1) To ensure the continuous and normal use of App functions: Retaining your creation data, operation records, practice data, etc., allows you to view, edit, export and share historical content at any time when using the App, and realize the core service functions of the App such as favorites, reporting, and practice statistics.

(2) To optimize App experience and ensure operational security: Retaining basic device information and operational fault information helps us fix compatibility problems, optimize App stability and interaction logic, and improve your overall use experience; retaining report/block records helps us filter inappropriate content and prevent malicious operations, creating a safe App environment.

(3) To comply with legal and regulatory requirements: In accordance with the provisions of GDPR, CCPA, CPRA and other global data protection laws and regulations, as well as the requirements of judicial and regulatory authorities, we need to retain relevant data for a certain period when necessary to fulfill legal obligations such as cooperation with investigations.

VI. Sharing, Transfer, and Sale of Personal Data, and Users' Right to Know About Data Sharing

We strictly protect your personal data, adhering to a "no sharing, no transfer, no sale" principle in general. Unless required by law or with your explicit written consent, we will not share or transfer your personal data with any third party. In accordance with the California Consumer Privacy Act (CCPA) and other relevant data protection laws and regulations, we explicitly inform you of the details of personal data sharing and your corresponding right to know about data sharing, and the definition of "share" in this Chapter complies with the specific provisions of California law.

(I) Definition of Data Sharing (in accordance with California law)

Pursuant to the CCPA, "share" refers to the disclosure of personal data by us to a third party for valuable consideration, including but not limited to the exchange, provision, or transfer of personal data for monetary or non-monetary benefits. It does not include the necessary disclosure of data in the process of providing App services in accordance with the law and without obtaining valuable consideration.
